An aggravated assault accusation can arise from many situations, including alleged physical confrontations, disputes, domestic incidents, or accusations involving weapons. However, an accusation is not the same as a conviction.
Under New Jersey law, prosecutors must prove the required elements of the offense beyond a reasonable doubt. A strong defense focuses on whether the evidence actually supports those elements and whether your constitutional rights were protected throughout the investigation.
Bernstein Criminal Defense helps Salem-area clients navigate complex criminal proceedings by focusing on:

Aggravated assault generally involves allegations that increase the seriousness of an assault offense. The circumstances surrounding the incident determine how the charge is classified and what penalties may apply.
Factors that may influence an aggravated assault charge include:
A Salem County aggravated assault case requires a detailed review because small factual differences can significantly impact the potential outcome.
Understanding the difference between assault charges can help explain why aggravated assault cases require serious legal attention.
Comparison | Simple Assault | Aggravated Assault |
Severity | Generally less serious offense | More serious criminal charge |
Injury Allegations | Usually involves minor injury or attempted harm | May involve serious bodily injury allegations |
Possible Classification | Often disorderly persons offense | Can involve indictable offense charges |
Legal Consequences | Fines, probation, other penalties | Greater risk of incarceration and long-term consequences |
Defense Approach | Depends on facts and evidence | Requires detailed criminal defense strategy |
Every case depends on its specific circumstances. The charge alone does not determine the outcome.
A criminal defense attorney examines the evidence collected during the investigation, including:
Errors, inconsistencies, or missing information may create important defense opportunities.
Depending on the facts, defenses may include:
New Jersey law recognizes that individuals may have the right to protect themselves from immediate threats under certain circumstances.
Some aggravated assault charges require prosecutors to prove specific conduct or intent. If those elements cannot be established, the defense may challenge the charge.
Mistaken identity or unreliable witness statements can become important issues in criminal cases.
The prosecution carries the burden of proof. If evidence does not meet legal requirements, the defense can challenge the strength of the case.
The consequences of an aggravated assault conviction may include:

Criminal Record | May impact employment and future opportunities |
Jail or Prison Exposure | Serious charges may involve incarceration risks |

Many people facing criminal charges are unsure what happens next. Understanding the general process can help you prepare.
Stage | What Happens |
Arrest or Investigation | Police may investigate allegations and gather evidence |
First Court Appearance | The court reviews the case status and legal requirements |
Discovery Process | Defense attorneys review evidence provided by prosecutors |
Negotiations or Motions | Legal teams may discuss resolutions or challenge evidence |
Trial Preparation | If the case continues, both sides prepare arguments and evidence |
The specific timeline depends on the complexity of the case, court schedule, and circumstances involved.
People charged with aggravated assault often compare hiring a private criminal defense attorney with accepting a court-appointed attorney.
Private Aggravated Assault Attorney | Public Defender |
Dedicated representation from a retained lawyer | Assigned representation for qualifying defendants |
More flexibility for communication and preparation | Handles many cases simultaneously |
Personalized case strategy | Limited resources may affect preparation time |
Focused attention on individual case details | Workload varies by office and jurisdiction |
Choosing legal representation is an important decision when facing serious criminal allegations.
There is no single defense that applies to every aggravated assault case. A lawyer evaluates the evidence and determines which arguments may provide the strongest protection.
Possible defense strategies may involve:
Evidence must be reliable and legally obtained. Problems with collection methods, witness statements, or documentation may affect the prosecution’s case.
Conflicting statements, poor identification, or credibility issues may create reasonable doubt.
If a person acted to protect themselves or another person from harm, self-defense may become an important issue.
In some situations, legal counsel may seek alternatives that reduce potential consequences depending on the facts and available option

In some cases, charges may be reduced or dismissed depending on evidence problems, legal defenses, negotiations, or other factors affecting the case.
A defense strategy may involve challenging evidence, questioning witness credibility, presenting self-defense arguments, or identifying weaknesses in the prosecution’s case.
Even a first aggravated assault charge can have serious consequences. Consulting with a criminal defense attorney can help you understand possible outcomes and available defenses.

Mark did an amazing job representing us and helped us tremendously over the past year with our youngest. He kept us informed and truly put our minds at ease. We couldn’t have asked for a better outcome. We’ve known and used Mark for well over 20 years and will always recommend his services to family and friends.Posted on Google debi jansmaTrustindex verifies that the original source of the review is Google. Even one star is too much to rank this lawyer. My 89-year-old mother-in-law had an accident with her car and a fire hydrant in early January and was referred to Mr. Bernstein by a family friend. What should have been a very simple hearing and fine was postponed time after time until we intervened and communicated with him by text. Finally in late April, the hearing was held, but Mr. Bernstein couldn't show and said he would sent a colleague. His colleague never showed up and my mother-in-law was forced to go through the whole thing by herself. His office never called about any of the prior postponements and our family had to constantly track the appointments and cancellations. As others have posted, it's "money up front" and no customer service to speak of. UPDATE: we had a longer talk today with my MIL and it turns out that a "nice young man" came up to her after the morning break and let her know he would take care of the situation. He did get the charge pled down to just a fine. Not being familiar with the process of court hearings, she thought the person was the court clerk, but it turns out that was Mr Bernstein's colleague. So I do need to retract that portion of my review. I do still stand by the observations on lack of customer service, and communication skills.Posted on Google Andrew DesmaraisTrustindex verifies that the original source of the review is Google. I am new to Mount holly I have been living here for 3 years and I d r c has had my license suspended for over 10 years and only should of been taken for 3 years I need to know what I can do to get my license back I completed all programs never did not complyPosted on Google Maddie EmTrustindex verifies that the original source of the review is Google. Attorney Mark Bernstein is absolutely outstanding- I’d give him 50 stars if I could. I met him 3 years ago when he represented me for careless driving and got the charge dropped with no points on my record. I met him again last month when my 20 year old son was arrested for DUI and breathalyzer refusal charges along with about 8 other unfair charges. I called Mark at 7:30am on a Saturday morning the day after and he immediately answered my call, and listened to what happened in a caring and non- judgmental way. He quickly took action by postponing the court date, carefully reviewing the police report. webcam and transcript data. Importantly, he kept me informed each step of the way answering all my texts and phone calls with no more than a 5 minute wait. Before me and my son showed up in court Mark told us he already had the situation handled! Myself and my son only spent about 5 minutes in court and had the charges dropped including DUI and breathalyzer refusal charges. All this for a one time fee that was extremely fair. My son can move on without a permanent DUI charge on his record. If you are looking for an intelligent and caring but highly aggressive lawyer (in a good way!) who has your best interest at heart look no further…Mark is simply the best!!Posted on Google Joshua MartelTrustindex verifies that the original source of the review is Google. I was skeptical because it seemed like a third of the reviews were negative in some kind of way. As a military veteran, I found Mr. Bernstein very professional and courteous. I was facing ten years. Long story short, my case was dismissed and expediently expunged. I was lucky the plaintiff didn’t show up, but also lucky to find proper representation within his practice, As the state picked up my case, he got it dropped to a municipal level. If it wasn’t for him, I would probably be behind bars, but instead I get a second chance at life, spending the holidays with my daughters & family. Highly suggestPosted on Google Calvin JohnsTrustindex verifies that the original source of the review is Google.
